1. The seller and the scope of these terms
Pristine Jewelers NY operates pristinejewelersny.com from its showroom at 25 W 47th Street GF 05, New York, NY 10036, United States.
These Terms of Sale govern every purchase made through pristinejewelersny.com. By placing an order or submitting a payment, the purchaser accepts these Terms of Sale, the Delivery & Returns policy and the Privacy Policy, each of which is incorporated into these terms by reference.
2. Prices
Prices published on the website are the prices at which pieces are offered for purchase through the website. Pieces marked price on request, pieces set with natural diamonds, and Pristine Timepieces are offered by inquiry, and their price is agreed between Pristine Jewelers NY and the purchaser directly. The amount authorized on the payment page constitutes the price of the order.
Prices are stated in United States dollars (USD) and do not include sales tax. New York sales tax shall be added at checkout, and displayed before payment, on orders delivered within the State of New York.
3. Orders and acceptance
An order placed through the website, or a payment submitted for a piece, constitutes an offer to purchase. No contract of sale is formed until Pristine Jewelers NY confirms acceptance of the order, which confirmation is sent by email.
Pieces are supplied from stock or made to order, and a piece may become unavailable after an order is placed. Pristine Jewelers NY reserves the right, prior to shipment and notwithstanding any authorization of payment, to decline or cancel an order where a piece is unavailable or cannot be produced within a reasonable time, where a price or description was published in error, or where the order cannot be verified. Where a price or description was published in error, Pristine Jewelers NY shall notify the purchaser before shipment, and the purchaser may confirm the order as corrected or cancel it for a full refund. Upon cancellation, the full amount charged shall be refunded to the original method of payment.
The appearance of colors and finishes may vary with the display on which they are viewed.
4. Payment
The payment methods available for an order are confirmed before payment is submitted. Where card payment is available, it is processed by Authorize.net on its hosted payment page. Card numbers are not entered on, received by, or stored on pristinejewelersny.com.
By submitting payment, the purchaser authorizes Pristine Jewelers NY and its payment processor to charge the agreed amount to the designated method of payment, and represents that the purchaser is entitled to use that method of payment and that the billing information provided is accurate.
Pristine Jewelers NY and its payment processor may review any transaction, and Pristine Jewelers NY may contact the purchaser to confirm order, payment or delivery details before an order is accepted or shipped.
5. Legal compliance
Pristine Jewelers NY complies with the anti-money laundering and sanctions laws of the United States, including the Bank Secrecy Act and the sanctions administered by the Office of Foreign Assets Control (OFAC) of the U.S. Department of the Treasury. Pristine Jewelers NY does not sell to any person or entity named on the OFAC Specially Designated Nationals list or owned by such a person or entity, and does not ship to any destination subject to U.S. sanctions that prohibit the sale. Pristine Jewelers NY may request the information required to meet these obligations and reserves the right to decline or cancel any order that cannot be completed in compliance with the law.
6. Delivery, title and risk of loss
Delivery methods, delivery times and the terms of international delivery are set out in the Delivery & Returns policy.
Title to a piece and the risk of loss pass to the purchaser when the package is delivered and signed for at the delivery address. Where the purchaser directs delivery to another person, the signature of that person constitutes delivery to the purchaser.
Where a piece is delivered outside the United States, the purchaser is responsible for compliance with the import laws of the destination country and for the customs duties and import fees levied there.
7. Returns, exchanges and custom orders
Returns, exchanges and custom orders are governed by the Delivery & Returns policy, which forms part of these terms.
8. Rights of the purchaser under the law
Nothing in these terms limits any right of the purchaser under applicable consumer protection law that cannot be limited by agreement.
9. Limitation of liability
To the fullest extent permitted by law, Pristine Jewelers NY shall not be liable for any indirect, incidental, special or consequential damages, including lost profits, arising from a purchase or from the use of the website. The total liability of Pristine Jewelers NY for any claim relating to an order shall not exceed the amount paid for that order. Certain jurisdictions do not permit these limitations, in which case they apply only to the extent permitted.
10. Events beyond reasonable control
Pristine Jewelers NY shall not be responsible for any delay or failure to perform caused by events beyond its reasonable control. Where such an event delays an order, the purchaser shall be informed as soon as practicable.
11. Concerns and disputes
Any concern about an order is to be raised with Pristine Jewelers NY in the first instance, and Pristine Jewelers NY shall endeavor in good faith to resolve it directly.
These terms, and any dispute concerning them or concerning a purchase, are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute not resolved directly shall be heard in the state or federal courts located in New York County, New York.
12. Changes to these terms
Pristine Jewelers NY may revise these terms from time to time. The version published on this page, bearing its “Last updated” date, governs orders placed on or after that date. A revision does not affect an order accepted before the revision.
13. General
If any provision of these terms is held unenforceable, the remaining provisions remain in effect. These terms, together with the Delivery & Returns policy and the Privacy Policy, constitute the entire agreement between the purchaser and Pristine Jewelers NY concerning the purchase. A failure by Pristine Jewelers NY to enforce a provision on one occasion does not waive its right to enforce that provision thereafter.
